General Terms and Conditions of Sale

These general terms and conditions of sale are intended to govern the commercial relations between the company SARL MEYLIV, HOTEL NATION MONTMARTRE, 4, rue Boissieu 75018 Paris, hereinafter
Preamble:
1. These General Terms and Conditions of Sale apply to individual bookings made by the customer for their personal needs.
2. The booking request entails adherence to these terms of sale and full and unreserved acceptance of their provisions.
3. The booking request must be made in the name of one of the persons who will be staying at the Hotel (hereinafter the “Customer”).
4. The customer acknowledges having read and accepted these general terms and conditions of sale and the terms of sale of the booked rate, which are available on the website.
5. The customer declares that they have the capacity to enter into a contract, that is, that they are of legal age and not under curatorship or guardianship.
6. The customer’s agreement to the general terms and conditions of sale and to the terms of sale of the booked rate is given at the time of booking; no booking is possible without this agreement.
7. Payment made at the time of a booking whose rate terms of sale do not allow the booking to be modified or cancelled will hereinafter be referred to as prepayment.
Article 1: Booking
1. The booking is deemed to be made upon validation of the bank details.
2. The customer may book on the Website, on an individual basis and for their personal needs, a limited number of rooms per booking and on a single Mobile Service. For any booking of more than 4 (four) rooms, the Hotel reserves the right to apply special pricing conditions and cancellation policies to the corresponding contracts.
3. Before making any booking, the customer undertakes to complete the information requested on the booking request.
4. The customer certifies that the information provided is truthful and accurate.
5. The booking procedure includes, in particular, the following steps:
- Step 1: choice of room and rate;
- Step 2: selection, where applicable, of one or more additional services (valid only on the website);
- Step 3: review of the booking details, its total price and the applicable terms of sale, and any adjustment of the choice (room, rate, additional service);
- Step 4: entry of the customer’s contact details;
- Step 5: entry of the bank card where a guarantee or prepayment is required
- Step 6: review and acceptance of the general terms and conditions of sale and of the terms of sale of the booked rate before validating the booking;
- Step 7: validation of the booking by the customer.
The Hotel acknowledges receipt of the customer’s booking by sending, without delay, an email to the customer at the email address previously provided, summarising the contract offer, the services booked, the prices, the terms of sale relating to the selected rate as accepted by the customer, and the date on which the booking was made.
Article 2: Cancellation conditions
1. The customer is reminded that, in accordance with Article L. 121-20-4 of the French Consumer Code, they do not have the right of withdrawal provided for in Article L. 121-20 of the French Consumer Code.
2. The terms of sale of the booked rate specify the conditions for cancelling and/or modifying the booking.
3. Bookings with prepayment cannot be modified and/or cancelled.
Sums paid in advance as a deposit will not be refunded. In this case, this is stated in the terms of sale of the rate.
4. Where the terms of sale of the booked rate allow, the booking may be cancelled directly on the Website or the Mobile Services via the section “View or cancel your booking”.
5. If the stay is interrupted (unexpected departure), the customer must also pay for the night of the day of departure. For bookings with prepayment, no refund will be made.
6. Unless expressly stated otherwise, rooms are available from 2pm on the day of arrival and the customer must vacate the room before 12 noon on the last day of the booking.
Late check-out is possible on request, subject to room availability and for an additional charge.
Article 3: Prices
1. Prices are shown in euros. Prices include the VAT applicable on the day of the order, and any change in the applicable VAT rate (10%) will automatically be reflected in the prices shown on the invoice date.
2. The prices shown include only the services expressly mentioned in the booking.
Any additional services provided by the hotelier during the stay and the tourist tax will be added to the price stated in the booking at the time of invoicing.
3. The applicable prices are those in force on the day of booking. Only the price stated in the booking confirmation is contractually binding.
Article 4: Payment terms
1. Payment for all services will be made directly at the hotel (except for bookings payable in advance at the time of booking).
2. Unless special conditions or rates apply, the customer provides their bank details as a guarantee for the booking, by credit card or store card (Visa, Mastercard, American Express), entering directly in the field provided for this purpose (secure SSL-encrypted entry) the card number, without spaces between the digits, together with its expiry date and security code.
3. Payment is debited at the hotel during the stay, except in the case of special conditions or rates where payment is debited at the time of booking (online prepayment on certain rates). This prepayment is deemed to be a deposit.
4. In the case of a rate subject to online prepayment, the sum paid in advance, which constitutes a deposit, is debited at the time of booking.
5. At the time of prepayment, the amount debited at booking includes: the price of the accommodation, the price of meals if breakfast is chosen, taxes and any other additional services selected by the customer, except the tourist tax
6. In the event of a no-show (booking not cancelled, customer not present) for a booking guaranteed by bank card, the hotel will charge the customer, as a fixed indemnity, the amount of the first night to the bank card provided as a guarantee for the booking.
7. The credit card used for a prepayment may be requested by reception on arrival at the hotel. It must be in the name on the booking. If not, it will be necessary to contact the hotel in advance to complete an authorisation form and provide a copy of the bank card and of the cardholder’s identity document for authorisation. Where applicable, the hotel may ask the customer to pay the deposit on site with their own bank card, in exchange for which the hotel will refund the deposit originally paid with the card used to make the booking.
Article 5: Relocation
In the event of force majeure, exceptional events or technical problems at the hotel making the customer’s stay impossible, the hotel will make every effort to find alternative accommodation, if possible in a hotel of the same or a higher category. Any additional cost of the room and the outward journey between the 2 hotels will be borne by the hotel.
Article 6: Stay at the hotel
1. On arrival at the hotel, the customer is asked to complete a registration form. To this end, each guest staying at the establishment will be asked to present an identity document in order to verify their identity. The hotel reserves the right to cancel the booking without refund if the customer does not present an identity document.
2. On arrival at the hotel, the customer will be required to provide a valid bank card in order to open a guarantee of €100. This amount will be automatically released on the day of the customer’s departure at 3pm.
3. The customer accepts and undertakes to use the room in a reasonable manner and in accordance with its intended purpose. Accordingly, any behaviour contrary to public decency and public order will lead the hotelier to ask the customer to leave the establishment without any compensation and/or without any refund, if payment has already been made. If no payment has yet been made, the customer must pay the full displayed public rate for the nights already used before leaving the establishment.
4. The customer undertakes that the IT resources (Wi-Fi access) made available by the hotel will in no way be used for unlawful purposes. The customer is also required to comply with the security policy of the hotel’s internet service provider, including the rules for using the security measures implemented to prevent unlawful use of IT resources, and to refrain from any act that would impair the effectiveness of these measures.
5. The customer will be held liable for any damage, deterioration or act of vandalism that may arise from the occupation of the premises and/or from the participants and/or staff for whom they are responsible, both to property and as regards damage resulting from the use of the internet network, such as data loss, viruses or service interruption.
6. Animals are not accepted in the establishment.
7. Smoking and vaping are not permitted inside the hotel. Otherwise, the customer will be liable to a penalty of €260.00 corresponding to the closure and full cleaning of the room.
Article 7: Complaints
Any complaint must be sent to the hotel or by registered letter with acknowledgement of receipt no later than 7 days after the departure date, failing which it will be time-barred.
Article 8: Liability
1. The photographs shown on the website are not contractually binding. Although every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the hotels presented give as accurate an impression as possible of the accommodation services offered, variations may occur, in particular due to changes of furniture or possible renovations. The customer may not make any claim on this basis.
2. The hotel cannot be held liable for the non-performance or improper performance of the booking in the event of force majeure, the act of a third party that is unforeseeable and insurmountable, or the act of the customer or of their partners, such as unavailability of the internet network, inability to access the website, external intrusion, computer viruses, or in the event of a prepayment not authorised by the cardholder’s bank.
Article 9: Privacy and protection of personal data
1. The Hotel carries out processing of personal data, for which it is the controller.
2. As part of this processing, the Hotel collects information concerning the customer’s identity, email and/or postal address, telephone number, the credit card information required to pay for the room and other information relating to the customer’s specific requirements.
3. On each personal data collection form, the customer is informed whether answers are mandatory or optional by the presence of an asterisk.
4. Any service will be recorded, and this record can be accessed by the customer on simple request at the following address: info@hotelnationmontmartre.com
5. In accordance with the amended Law 78-17 of 6 January 1978 on data processing, data files and individual liberties (“Informatique et Libertés”) and the General Data Protection Regulation which came into force on 25 May 2018, the customer has a right of access, rectification and objection regarding the personal data processed concerning them.
6. The customer may also refuse processing, request its restriction or request the erasure (within the limits of the legal retention periods) of personal data.
7. This right may be exercised by simple written request to info@hotelnationmontmartre.com, which will respond to the requests made.
8. The purpose of processing the personal data collected corresponds to the obligations relating to the services provided (customer management, commercial prospecting, compiling statistics).
9. Certain personal data may be collected for services provided by the
Hotel’s service providers for the purposes of booking or performing the contract, hotel reservations, quality control management and complaints (TOPSYS, APALEO). These service providers have their own privacy policies. We accept no liability for their policies or for their processing of personal data.
Article 10: Governing law and language
These general terms and conditions of sale are governed by French law. The authoritative language is French. Should the general terms and conditions of sale be translated into a foreign language, the French language shall prevail over any other translation in the event of any challenge, dispute or difficulty of interpretation or performance of these terms and, more generally, regarding the existing relations between the parties
Article 11: Changes / amendments to the general terms and conditions of online sale
These General Terms and Conditions of Online Sale may be amended and/or supplemented at any time. As soon as it is published online, the new version of the General Terms and Conditions of Online Sale will automatically apply to all customers.
